These Terms of Service ("Terms") govern your access to and use of keeppix ("we," "us," or "our"), a client photo gallery platform for professional photographers. By creating an account or using our service, you agree to these Terms in full. If you do not agree, do not use keeppix.
keeppix provides cloud-hosted photo gallery software that allows photographers ("Users") to upload, organize, and share photos with their clients. Features include password-protected galleries, client favoriting and proofing, photo downloads, comments, analytics, custom branding, and optional facial recognition sorting.
We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.
You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at info.keeppix@gmail.com if you suspect unauthorized access.
You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement.
You may not create more than one account per person, share your account with others, or use another person's account without their permission.
keeppix offers a free tier and paid subscription plans billed monthly. Paid plans are processed through Stripe, our third-party payment processor. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
You may cancel your subscription at any time through the billing portal in your account settings. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. We do not provide prorated refunds for partial months.
If a payment fails, we will attempt to retry the charge. If payment remains unsuccessful after reasonable attempts, your account may be downgraded to the free tier and gallery access may be restricted.
We reserve the right to change pricing with at least 30 days' notice to existing subscribers via email. Continued use after a price change constitutes acceptance of the new pricing.
You retain full ownership of all photos and content you upload to keeppix. By uploading content, you grant us a limited, non-exclusive, royalty-free license to store, display, and deliver your content solely for the purpose of providing the service to you and your clients.
We will never use your photos for marketing, AI training, or any purpose other than operating the service on your behalf.
You represent and warrant that you own or have the necessary rights to upload all content, and that your content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.
keeppix, its logo, and all related software are the intellectual property of keeppix and may not be copied, modified, or used without our express written permission.

We reserve the right to remove any content and suspend or terminate any account that violates these terms, without prior notice.
Each plan includes a storage limit as described on our pricing page. If you exceed your storage limit, uploads will be blocked until you upgrade your plan or delete existing content.
We store your photos on Amazon Web Services S3 in a secure, access-controlled environment. While we take reasonable measures to protect your data, we strongly recommend maintaining your own backups of original files. We are not liable for any data loss.
Upon account deletion or plan cancellation, your content will be retained for 30 days to allow for recovery, then permanently deleted. Content associated with delinquent accounts may be deleted sooner.
The facial recognition feature (available on Pro and Studio plans) uses Amazon Rekognition to detect and group faces in photos within a gallery. This feature is disabled by default and must be explicitly enabled per gallery by the photographer.
By enabling this feature, you represent that you have obtained any required consent from individuals whose images will be processed, as required by applicable laws in your jurisdiction (including but not limited to BIPA in Illinois and GDPR in the EU). You are solely responsible for compliance with biometric data laws in your jurisdiction.
Face data is stored in a private collection associated with your gallery and is deleted when you disable the feature or delete the gallery.
When you share a gallery with clients, those clients may view photos, submit favorites, leave comments, and download photos (subject to your gallery settings). You are responsible for managing gallery access and ensuring only intended recipients have access to password-protected content.
Client email addresses entered into keeppix are used solely to provide the service (sending gallery invites, favorites notifications, etc.) and are not used for our own marketing purposes.
You may delete your account at any time from your account settings. We may suspend or terminate your account immediately, without notice, if you violate these Terms or if we are required to do so by law.
Upon termination, your right to use the service ceases immediately. Sections 4 (Content and Intellectual Property), 10 (Disclaimer), 11 (Limitation of Liability), and 12 (Governing Law) survive termination.
keeppix is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, keeppix and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the service.
Our total liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the greater of (a) the total amount you paid us in the 12 months preceding the claim, or (b) $100.
You agree to indemnify and hold harmless keeppix and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your content, or your violation of these Terms.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
We may update these Terms from time to time. When we do, we will update the effective date above and, for material changes, notify you by email at least 14 days before the changes take effect. Your continued use of keeppix after the effective date constitutes your acceptance of the revised Terms.
